Terms and Conditions — DrinkCalc

These Terms govern your use of mydrinkcalc.com and the purchase of the DrinkCalc Excel file (“Product”). By using the website or purchasing the Product, you agree to these Terms.

2. Product Description
DrinkCalc is a downloadable Excel spreadsheet for beverage formulation calculations. The Free version provides basic tools; the Premium version adds further functionality and an editable ingredient database. A compatible spreadsheet application (e.g., Microsoft Excel) is required to use the Product. No installation is needed.
3. Pricing and Payment
Prices are displayed in US dollars (USD). Payments are processed securely by Stripe. By purchasing, you agree to Stripe’s terms.
4. Digital Delivery
After payment, the Premium version is delivered by email to the address provided at checkout. Please ensure the email address is correct before completing the purchase.
5. Right of Withdrawal (EU Consumers)
For consumers resident in the European Union, EU Directive 2011/83/EU grants a 14-day right of withdrawal for distance sales.
For digital content delivered without a physical medium (such as DrinkCalc), this right is lost once download or delivery has begun, provided that the consumer has expressly consented to immediate delivery and acknowledged the loss of the withdrawal right. By completing the purchase and proceeding to download, you give this express consent.
If you have not yet downloaded or received the file, you may withdraw within 14 days by emailing info@mydrinkcalc.com.
6. Refund Policy
Because DrinkCalc is a digital product delivered immediately upon purchase, refunds are generally not available once delivery has been completed and the right of withdrawal has been waived as described in section 5.
If you experience technical issues receiving or opening the file, contact info@mydrinkcalc.com and we will assist you. In the case of a demonstrable defect that we cannot resolve, we will issue a refund.
7. Use License
Your purchase grants you a non-exclusive, non-transferable license to use DrinkCalc for personal or professional purposes within your organisation.
You may not:
- Resell, redistribute or publicly share the file
- Claim authorship of the file
- Reverse engineer locked elements for redistribution
Internal company use is permitted, provided the file is not distributed externally.
8. Updates
Premium users may receive minor improvements and updates to the current version at no additional cost. Major future versions may be sold separately.
9. Liability
The Product is provided “as is”. We do not guarantee that calculations generated by the Excel file will be free of error or suitable for any specific industrial application; the user remains responsible for verifying results before any commercial or production use.
To the maximum extent permitted by law, we are not liable for indirect or consequential damages, business or production losses, or formulation errors arising from incorrect inputs. This limitation does not affect the mandatory rights of consumers under their applicable law.
10. Intellectual Property
All materials on the website and within the Excel file (including formulas, structure and documentation) are the intellectual property of DrinkCalc and protected by copyright law.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Thailand, where the seller is established. For consumers resident in the European Union, this choice of law does not deprive you of the protections granted by the mandatory provisions of the law of your country of residence.
